APCs tender not to be reviewed by the Office

Mr Martin Pecina, Chairman of the Office for the Protection of Competition, rejected by his second-stage decision of 7th June 2006 an appeal of the company Patria Vehicles Oy against first-stage decision of the Office dealing with the company´s objections against the Ministry of Defence tender for supply of up to 234 Armored Personnel Carriers (APCs) for the Czech Army.

Patria lodged a submission for review of the acts of contracting authority after its bid hadn´t succeeded in the tender. The Office stated in its first-instance decision that the public procurement law doesn’t apply to military tenders, therefore it can´t review the tender. The company Patria appealed, but the Chairman of the Office rejected the appeal and confirmed the first-instance decision, because the company didn´t bring new relevant facts.
