The Office for the Protection of Competition imposed a fine amounting to 480,284 CZK on the Statutory City of Brno for breach of the Act on Public Procurement.
In its first-instance decision of 8 August 2002 the Office assessed in total 17 cases of contracts concluded by this contracting authority. In 12 cases the Office found serious breaches of the act. The highest fine amounting to 300,000 CZK was imposed for breach of the act in the case of contract concerning the “reconstruction of the building of Janaček’s Theatre in Brno”. In the submitted documentation there were, before conclusion of the contract, not included the proofs of qualification prerequisites of the selected tenderer. Furthermore, the contracting authority did not choose the selection of contract partner adequate to the amount of future financial commitment involved and subsequently concluded supplements to the original contract by way of invitation for bid from a single candidate without satisfying the legal requirements.
